2008 Gold Star Chili “Get Lost in the States” Instant Win Game and Sweepstakes Promotion

THIS PROMOTION IS INTENDED FOR PLAY IN THE UNITED STATES (BY LEGAL RESIDENTS OF THE STATES OF KENTUCKY, OHIO & INDIANA) ONLY AND PARTICIPATION IS GOVERNED BY U.S. LAW.  DO NOT ENTER IF YOU ARE NOT LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY.

1. Eligibility: The Gold Star Chili “Get Lost in the States” Instant Win Game and Sweepstakes Promotion (The “Promotion”) is open to legal residents of KY, OH, & IN 13 years of age or older.  Employees of Gold Star Chili, its affiliates and subsidiaries, the judging organization, and any other individual or company involved in the development, promotion, or execution of the Promotion, including advertising, promotional and service agencies, and the immediate families (spouse, parents, children, siblings, and in-laws) and individuals living in the same households of such employees are not eligible. The Promotion is subject to all applicable federal, state, local laws and regulations. The Promotion void outside KY, OH, & IN and where prohibited by law.

2. How to Play Instant Win Game: Beginning April 14, 2008, customers of participating Gold Star Chili restaurants will receive an official game piece with the purchase of a 32oz. drink, while supplies last. Peel open the game piece to see if you are a winner.  Non-winning game pieces will have a map puzzle piece and code, which may be used to enter the Sweepstakes (see Section 5 below). Game ends June 14, 2008, or when supplies of game pieces are exhausted.

How to Get a Game Piece Without Purchase: To request a free game piece (while supplies last) and a copy of the Official Rules by mail, send a self-addressed stamped envelope to: Gold Star Chili “Get Lost in the States” game piece request, PO Box 357, South Bend, IN 46624-0357. Requests must be postmarked by June 14, 2008 and received by June 21, 2008. Limit one (1) request per outer postmarked envelope. Sponsor is not responsible for lost, late, misdirected, damaged, incomplete, illegible, or postage-due mail.

Instant Win Prize Claims: Instant win pieces may be redeemed at participating Gold Star Chili restaurants through June 30, 2008.  Limit one prize redemption per customer per store visit.  No substitutions or cash redemptions permitted.  Items subject to availability.  Prizes may not be combined with other offers.  Winning game pieces may not be transferred or sold.  Only original winning game pieces will be accepted and all winning game pieces are subject to verification.

5. How to Enter Sweepstakes: Consumers who receive map puzzle pieces will be directed to www.goldstarchili,com to register and enter the map piece code for entry into the Sweepstakes. Limit: one (1) entry per code, however, there is no limit to the number of Sweepstakes entries that a consumer may receive.  Automated methods of entry are prohibited.  Sweepstake entries must be received by 11:59:59 PM ET on June 30, 2008. Additional methods of entry include:

a)     Members of Gold Star Chili’s eClub or consumers who join eClub will receive one (1) additional entry into the Sweepstakes.

b)    Consumers may ‘refer a friend’ by providing email addresses of friends for inclusion in an email notifying consumers about the promotion[BDF2] . Consumer will receive one (1) additional sweepstakes entry for submitting email addresses.  You may only provide email addresses of individuals you know personally, and you believe would like to learn of this promotion.  Limit 1 entry per person via this method of entry.

c)     If a consumer finishes the online puzzle (by entering codes from game pieces representing all 5 map pieces), he/she will receive an additional five (5) entries into the Sweepstakes.

6. Sweepstakes prizes:

Grand Prize Trip Details: Trip includes roundtrip coach class air travel for two (2) to a destination of choice in the 48 contiguous United States (excludes AK & HI) and double occupancy hotel accommodations for six (6) nights / seven (7) days as serviced by the sponsors air carrier and hotel of choice. Trip also includes $1,975 cash.   The actual value of the trip will vary depending on winner’s point of departure and airfare fluctuations. Any difference between stated approximate retail value and actual value of prize will not be awarded.  Travel arrangements are subject to availability.  All travel-related expenses not set forth herein, including but not limited to meals, ground transportation, gratuities and incidental hotel expenses, are the sole responsibility of the winner. Travel must be completed by July 11, 2009 or the prize will be forfeited.  Guest of Grand prize winner may only be a minor if Grand Prize winner is guest's parent or legal guardian, and signs all required documents on behalf of minor guest.  The cash portion of the prize will be paid by a check payable to the winner and may be used towards applicable taxes on Grand prize.  If Grand prize winner is an eligible minor, prize will be awarded to winner's parent or legal guardian.

No substitution, cash redemption or transfer of any prize by winner permitted.  All makes and models of prizes will be determined by sponsor. All federal, state and local taxes are the sole responsibility of winner.   Sponsor reserves the right to substitute a prize of equal or greater value.  Gift cards are subject to terms set by issuer.

7. Sweepstakes Drawings: Drawing will be conducted from among all eligible entries received on or about July 11, 2008 by The Ignition Network, an independent judging organization, whose decisions are final on all matters relating to the Promotion. Odds of winning a Sweepstakes prize are dependent upon the total number of eligible entries received.

8. Sweepstakes Winner Notification: Potential Grand prize winner will be notified by mail/overnight delivery and required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (except where prohibited) within 14 days of attempted notification or prize will be forfeited in its entirety and may be awarded to an alternate winner. Guest of potential Grand prize winner will also be required to sign and return a liability/publicity release within 14 days of attempted notification or prize will be forfeited in its entirety and may be awarded to an alternate winner.  Failure to provide all required information and a signature on the documents will result in forfeiture of winner’s right to claim a prize. First, Second, Third, and Fourth prize winners will receive their prize within 30 days of random drawing. In the event of noncompliance with these official rules, or if prize is unclaimed or returned as undeliverable, the prize will be forfeited and may be awarded to an alternate winner.

9. Additional Terms: By accepting a prize, winners consent to the use of their names, likenesses, voices and/or biographical information for advertising and promotional purposes without additional compensation, except where prohibited by law.  All winners, by acceptance of prize(s), acknowledge compliance with these Official Rules and agree to release and hold Sponsor, its affiliates, subsidiaries, and each company’s respective officers, directors, employees, independent contractors, representatives, and agents (“Releasees”) harmless from and against any claim or cause of action arising out of participation in the game or the receipt, redemption or use of a prize, including any injuries or damages of any kind sustained in connection with the use, acceptance, possession or awarding of any prize.  By participating in this promotion, you agree to be bound by the Official Rules and by the decisions of the judging organization, which are final and binding on all matters.  Sponsor reserves the right to modify prize award procedures at its discretion.

10. Limitation of Liability: Releasees are not responsible for printing, typographical, human or other errors of any kind in any promotion-related materials; for stolen, lost, late, misdirected, damaged, incomplete, illegible, or postage-due mail or entries; or for transactions that are lost, misdirected, or fail to enter into the processing system; or are processed, reported, or transmitted late or incorrectly; or are lost for any reason, including computer, telephonic, paper-transfer, or human error, or electronic, computer, or telephonic malfunction, damage, error, omission, interruption, defect, delay in operation or transmission, or any combination thereof.  Sponsor's liability for defective game pieces is limited to replacement with another game piece, while supplies last.  Sponsor will not award more that the number of instant prizes stated above for any reason.  If, for any reason, this Promotion (or any portion thereof) is not capable of running as planned, or infection by computer viruses, bugs, or tampering, unauthorized intervention, fraud, actions of entrants, technical failures, or any other causes corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Promotion, Sponsor reserves the right at its sole discretion to disqualify any entry or entrant and/or to cancel, terminate, modify, or suspend the Promotion and award prizes from among all eligible non-suspect entries validly received prior to the action requiring such modification.  By entering, all entrants agree that this Promotion is governed by laws of the state of Ohio for the resolution of all claims and disputes.

11. Winners List: For the names of Sweepstakes prize winners, mail a self-addressed, stamped envelope to: PO Box 1252, South Bend, IN 46624-1252. Requests must be received by August 11, 2008. The winners list will be sent when drawings have been conducted and all winners have been verified.
